1. Agreement to Terms

These Terms of Use constitute a legally binding agreement between you (“User”) and Lumia Stream LLC (“Company”, “we”, “us”, or “our”) concerning your access to and use of our services, including but not limited to the Lumia Stream software, website, and related applications (collectively, the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST CEASE USE OF THE SERVICE IMMEDIATELY.

Supplemental terms and policies may be posted from time to time and are incorporated herein by reference. Lumia Stream reserves the right to update these Terms at any time by modifying the “Last Updated” date. Continued use of Lumia Stream constitutes acceptance of any changes.

2. License

Subject to compliance with these Terms, Lumia Stream hereby grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the software strictly for its intended purposes, in accordance with applicable laws and regulations. Each purchased license is assigned to a single user and may not be shared, resold, or transferred without prior written consent.

3. User Responsibilities

By using Lumia Stream, you confirm and accept the following:

  • The registration details you provide must be accurate and kept up to date.
  • You are legally capable of entering into this agreement.
  • You are of legal age in your jurisdiction.
  • You will not use Lumia Stream for any illegal or unauthorized purposes.
  • Any attempt to circumvent security features or engage in fraudulent activities will lead to immediate account suspension.

Violation of these terms may result in permanent account termination.

4. Restrictions

You explicitly agree that you will not:

  • Reverse-engineer, modify, or create derivative works of Lumia Stream.
  • Sell, license, rent, or distribute Lumia Stream or its components.
  • Circumvent any security or licensing mechanisms within the software.
  • Use automated systems (bots, scripts) to interact with Lumia Stream.
  • Interfere with or disrupt the software’s operation, including introducing malware.

5. Refund Policy

ALL PURCHASES ARE FINAL. Refunds will only be issued where legally required. Unauthorized chargebacks will result in account suspension and legal action.

If technical issues arise, you must contact Lumia Stream support before seeking a refund.

6. Third-Party Services & API Dependencies

Lumia Stream integrates with external services (e.g., Twitch, YouTube, Kick, Philips Hue, Razer Chroma). Lumia Stream does not guarantee the availability or continued compatibility of these services and shall not be held liable for any interruptions or changes in third-party APIs.

Users are responsible for complying with the respective terms of third-party services.

7. Data Privacy & International Users

Lumia Stream uses cookies for improved user experience, including login persistence and analytics. No personally identifiable information is stored in cookies. Disabling cookies may impact software functionality.

Lumia Stream does not actively process personal data under GDPR. Users outside the United States are solely responsible for ensuring compliance with their local laws. Lumia Stream operates under U.S. data protection laws.

8. Service Modifications & Updates

Lumia Stream reserves the right to modify, suspend, or discontinue any feature at its sole discretion and without prior notice. Updates may introduce new features, bug fixes, or API adjustments. Users are responsible for keeping their software up to date.

9. Termination

Lumia Stream reserves the absolute right to terminate access to its services for violations of these Terms, fraudulent activity, or platform misuse. No refunds will be issued in such cases.

Upon termination, the user must immediately cease use and remove all copies of the software.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUMIA STREAM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BY USING LUMIA STREAM, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND ACCEPT THIS LIMITATION OF LIABILITY.

11. Copyright & Intellectual Property

Lumia Stream and all related assets (branding, source code, UI elements, and proprietary integrations) are protected by copyright and intellectual property laws. Unauthorized reproduction, modification, or distribution is strictly prohibited.

If you believe any content within Lumia Stream infringes on your copyright, you may file a DMCA takedown request by contacting legal@lumiastream.com.

12. Dispute Resolution & Arbitration

ALL DISPUTES ARISING FROM OR RELATED TO THESE TERMS SHALL BE RESOLVED THROUGH BINDING ARBITRATION IN GEORGIA, USA.

YOU HEREBY WAIVE ANY RIGHT TO PARTICIPATE IN CLASS-ACTION LAWSUITS AGAINST LUMIA STREAM.

Exceptions to arbitration include claims related to intellectual property infringement or legal actions requiring injunctive relief.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Georgia, USA, without regard to conflict of law principles.

14. Amendments to These Terms

Lumia Stream reserves the right to modify these Terms at any time. Changes take effect immediately upon publication. Continued use of Lumia Stream after any modifications shall constitute acceptance of the updated Terms.
